GENERAL CONDITIONS OF SALE

The following conditions are valid from July 2020 and may be updated or modified at any time by MAATROOM which will communicate it through a notice that will be published on its website. The consumer undertakes and is obliged, whenever there is a modification of these general conditions, to provide for their printing and storage.

1. OBJECT OF THE ONLINE CONTRACT AND ITS DEFINITION

The "online" sales contract is defined as a distance contract, i.e. the legal transaction concerning movable goods and / or services stipulated between MAATROOM in the role of supplier and a consumer, within a distance sales system organized by the supplier who, for this contract, uses exclusively the distance communication technology called "the Internet". All contracts, therefore, will be concluded directly through access by the consumer to the website corresponding to the address www.maatroom.com where, following the indicated procedures, the contract for the purchase of the goods will be concluded. A consumer is a natural person who purchases goods and services for purposes not directly related to his or her professional activity.

This document (together with any documents herein mentioned) sets forth the terms and conditions governing the use of this website and the purchase of items through this website (hereinafter, the "Terms"). Please read through these Terms, our Cookies Policy and our Privacy Policy (together the "Data Protection Policies") prior to using this website. By using this website or placing an order through it, you are consenting to be bound by these Terms and our Data Protection Policies. If you do not agree to all of the Terms and the Data Protection Policies, do not use this website. These Terms and the Data Protection Policies may be amended. 2. MINIMUM CONTENT OF PRODUCT INFORMATION

All products marketed by MAATROOM are designed and manufactured in Italy. There are no materials or substances that could cause harm to people, the environment or property.

3. OBLIGATIONS OF THE BUYER

The consumer undertakes, once the online purchase procedure has been completed, to print and keep these general conditions, which, moreover, he or she will have already viewed and accepted when confirming the order, as well as the specifications of the product being purchased.

It is forbidden for the buyer to enter false, and / or invented, and / or fantasy data in the registration procedure necessary to activate the process for the execution of this contract and the related further communications; Personal data and e-mails must be exclusively the buyer’s real personal data and not of third parties, or false. It is expressly forbidden to make double registrations corresponding to a single person or to enter data of third parties. MAATROOM reserves the right to prosecute any violation or abuse in the interest and for the protection of all consumers; In addition, in order to prevent abuse or incorrect actions of commercial practice, the company will contact the person concerned directly using the information acquired.

The Customer raises MAATROOM from any liability arising from the issuance of incorrect tax documents due to errors in the data provided by the Customer, being the Customer who is solely responsible for the correct insertion.

4. AVAILABILITY OF PRODUCTS

The computer system that characterizes this site is designed to ensure the immediate fulfillment of orders and avoid unnecessary waiting for the customer; In fact, it indicates in real time, in its electronic catalog, the physical availability of the product. If an order exceeds the quantity existing in the warehouse, MAATROOM will inform the buyer whether or not the product is available in the future; If so, the system allows you to pre-order the material. The pre-order will be considered completed only after full payment of the price by the customer. The customer will have the right to cancel his or her pre-order and obtain a refund of the price up to the date of shipment of the material, as indicated by MAATROOM when confirming the order. In case of impossibility for MAATROOM to produce the pre-ordered material, MAATROOM will promptly notify the customer and will refund the full price already paid by the customer.

5. SHIPPING AND RETURNS

SHIPMENTS

MAATROOM chooses Mail Boxes Etc. as a delivery partner (from Monday to Friday). For information on the service visit the websitewww.mbe.it. It is the customer's responsibility to explicitly request the need to receive an invoice when confirming the order, which, if requested, will be sent together with the package in paper form. In the case of a request to send electronic invoices, please make an explicit request indicating (if in possession) your e-mail address with the legal value.

Orders are shipped directly from MAATROOM (Turin – Italy) from Monday to Friday from 10:30 to 17.30. Orders placed on Friday evening, Saturday and Sunday will be processed the following Monday.

When the order is shipped, the customer will receive an e-mail from MAATROOM specifying the tracking number to monitor the status of the shipment.

All Customers who place an order establish a business relationship with MAATROOM and therefore undertake to accept delivery of the goods.

If, for any reason, the Customer refuses to take charge of the goods upon delivery, resulting in the return of the material to the sender, any shipping costs, customs charges and taxes charged to MAATROOM will be deducted from any refund due to the Customer. 

RETURNS

If for any reason the Customer is not satisfied with their purchase, the items can be returned within 14 days from the date of delivery. In order to proceed with the return, the customer must complete the ‘Returns Form’ which is available on the MAATROOM site. The Returns Form must be completed in its entirety and attached to the material to be returned to MAATROOM. The return must be received at the headquarters of MAATROOM. The shipping costs for the return of the item(s) will be borne by MAATROOM.

Terms and conditions for returns:

  1. The garments must not have been washed or altered and must not show any sign of use;
  2. Each item must be returned including all labels, packaging and original accessories (hangers, garment covers, etc.) received with the order;
  3. All returned items are inspected by MAATROOM upon receipt and must comply with all the parameters listed in the return procedure.

In the event that the returned material complies with all the parameters listed above, MAATROOM will refund the price already paid by the customer including shipping costs (with the exception of any additional costs deriving from the choice of a type of delivery other than the standard MAATROOM shipping provider). The customer will receive the refund from MAATROOM within 30 days of receipt of the material by MAATROOM at its premises.

7. GUARANTEE

Purchases made on Maatroom.com are subject to the rules of the Consumer Code regarding warranty for defects and discrepancies of the products. The customer will therefore be granted the rights referred to in art. 130 of the Consumer Code and these rights must be exercised within the terms of art. 132 of the same Consumer Code

8. LIABILITY

MAATROOM assumes no responsibility for disruptions due to force majeure and / or unforeseeable circumstances such as accidents, thefts and / or robberies of the courier in charge of delivery, fires, explosions, strikes and / or blackouts, earthquakes, floods and other Acts of God or similar events that prevent, in whole or in part, the execution of the contract in the time and or manner agreed. MAATROOM will not be liable to any party for damages, losses and costs incurred as a result of failure to execute the contract for the reasons mentioned above, as the consumer is only entitled to a refund of the price paid. Likewise, MAATROOM is not responsible for any fraudulent or illegal use that may be made by third parties upon payment of the products purchased.

9. CONTRACT TERMINATION AND EXPRESS TERMINATION CLAUSE

MAATROOM has the right to terminate the contract by simply notifying the customer with adequate and justified reasons; In this case, the Customer will only be entitled to a refund of any amount already paid. The obligations assumed by the customer pursuant to art. 4 (Obligations of the Buyer), as well as the guarantee of the successful completion of the payment that the customer makes with the means referred to in art. 6, are essential, so that by express agreement, the non-fulfillment, by the Customer, of only one of these obligations will determine the termination of the contract pursuant to art. 1456 of the Italian Civil Code, without the need for a judicial ruling, without prejudice to the right for MAATROOM to take legal action for compensation for further damage suffered.

10. ANTI-MONEY LAUNDERING

MAATROOM is attentive to compliance with the provisions on anti-money laundering and transparency of financial flows. In light of the ‘Spesometro’ (introduced by Legislative Decree 78/2010) coming into force, customers are advised that payments above the legal threshold will be registered in the Black List, or more precisely, will be brought to the attention of the Tax Registry; Therefore, for the purposes of fulfilling these tax rules, each user is obliged to release their own tax code. Furthermore, please note that in compliance with anti-money laundering provisions, cash payments for amounts equal to or greater than € 1000.00 are not allowed.

11. JURISDICTION AND COMPETENT COURT

For any dispute that may arise in connection with the GCS and / or sales contracts, customers may initiate an out-of-court dispute resolution procedure in accordance with the requirements of Articles. 141 et seq. of the Consumer Code. In the event that the Customer activates the aforementioned procedure, MAATROOM guarantees its participation in an attempt at an amicable settlement that the user can advance at the competent offices (such as: the online dispute resolution procedure available on http://ec.europa.eu/consumers/odr/). In case of the impossibility of an amicable resolution of the dispute, the rules of the Consumer Code will apply in relation to the judicial jurisdiction.
